Please find enclosed herewith the tender documents for the above work which includes - (i) Pre-qualification requirements, (ii) Technical Bid - comprising of Invitation for tender, instructions to tenderers & terms & conditions, preamble to schedule of work & Special conditions and (iii) Price bid comprising of schedule of work.

The pre-qualification documents will be opened first. The technical bids of only pre-qualified bidders will be considered. The price-bids of technically qualified bids will be opened subsequently. The date of opening of price bids will be intimated to all eligible bidders over telephone/fax.

KIOCL's decision on pre-qualification and Technical evaluation shall be final and no correspondence shall be entertained in this regard.

PRE-QUALIFICATION

  The parties who are sending their letter of expression must furnish following details along with documentary evidence of their claims.

SPECIFIC

  Bidders for pre-qualification have to submit documents to confirm that they have conducted at least two comparable studies of this nature.

Owner's decision in this regard shall be final and binding.

The technical bids of only pre-qualified bidders will be considered.

TECHNICAL AND COMMERCIAL BID

I. INVITATION TO TENDER

1. Bid documents for the above work are enclosed herewith.

2. Sealed bids will be received upto 15.00 Hrs. on 06.03.2006. at the office of Contracts Section of Projects Department, Kudremukh Iron Ore Company Limited, Panambur, Mangalore - 10. Bids received late are liable for rejection.

3. Bidders shall abide by all the details of "Instruction to Bidders" enclosed with the tender documents. The sealed bids shall be submitted in three separate sealed covers - (1) Pre-qualification documents, (2) Technical bid and (3) Price Bid each sealed bids shall be superscribed with the respective subjects and shall be addressed to Deputy General Manager (Projects), Kudremukh Iron Ore Company Limited, Panambur, Mangalore - 575 010.

4. The Technical Bid shall be accompanied by an Earnest Money Deposit (EMD) of Rs.2,000.00 (Rupees two thousand only) to be deposited in the form of a Demand Draft from a Scheduled Bank drawn in favour of Kudremukh Iron Ore Company Ltd., Panambur, Mangalore or in cash in KIOCL's Accounts Department.

5. EMD shall be adjusted to the Security Deposit in the case of successful bidder. However, the same shall be returned to the unsuccessful bidders immediately after the award of work to successful bidder.

6. Acceptance of the bid will be intimated to successful bidder through a letter enclosing the copies of the Letter of Intent (LOI) and this letter will be treated as authorization for award of work. The bidder shall sign the said copies of LOI and send to the owner within five days from the date of receipt for formal signature and issue of the same. In the event of failure on the part of the bidder to sign and return the LOI within the specified time, the EMD shall be liable to be forfeited at the sole discretion of the owner.

7. The Company reserves the right to reject any or all the tenders without assigning any reason.

II. INSTRUCTION TO TENDERERS

1. Tenderers  have to acquaint themselves with  the  conditions prevailing at site, before submitting the tenders.

2.Tenderers  shall  furnish their quotation  in  the `Schedule of Work' enclosed to the Price-bid documents. Quotations should be written in both words and figures.

3. Tenders submitted without EMD will not be considered.

III. TERMS AND CONDITIONS

 1.The work shall generally be governed by KIOCL's General Conditions  of Contract which is available for reference  in the office of Deputy General Manager (Projects) on all working days.

2. Scope of work in this contract broadly covers the following.

(a) As per Preamble to schedule of work and Special conditions of contract

3.  The quantities given in the schedule of items are approxi­mate and may vary or some of the items may not be executed. No claim by the contractor on account of variations, omis­sions and modifications will be entertained.

4.  No escalation is admissible on any account whatsoever.

5.  Rates quoted against schedule items shall include all mate­rials, labour, machinery expenses and hire charges, taxes, royalties, transport, maintenance incidents, enabling works etc.  based  on  the conditions mentioned herein.  Unless otherwise specified in the tender schedule the rates for all items will be deemed to include all leads, lifts and decents in the work.

6.  The work executed shall be maintained in good condition for a period of NIL MONTHS from the date of completion.

7.  Any damage to the company's property caused by the contrac­tor  during  the execution of work,  shall  be charged to the contractor and the amount of damage shall be left to the sole discretion of the Engineer.

8. Statutory deduction towards all applicable taxes  shall  be made as per rules.

9. Royalties  if any for materials applicable shall have to  be paid by the contractor.

10.  All safety appliances like safety belt, helmets etc. have to be provided by the contractor to all his workers and super­visors. None of the workmen without safety appliances shall be allowed to work at heights.

11.  The contractor shall abide with all the provisions contained in Factories Act and Rules/Regulations/Bylaws/Orders made thereunder.

12.  The contractor should obtain Insurance Policy to cover the risk of the labourers under Workmen Compensation Act and should be produced before starting the work.

13.  Contractor should produce the PF code number obtained from the authorities of Regional Provident Fund Commissioner to the Personnel Department before commencement of the work.

14. Time of completion and Liquidated Damages :

The entire work under this Contract shall be  completed as per the completion schedule specified under 'D' of Preamble to Schedule and Special Conditions. If the contractor fails to complete the work within the stipulated completion time, the contractor shall pay to owner as liquidated damages for such default, for every day which shall elapse between the  date prescribed thereof and the actual date of completion of  the scope of work, the amounts determined on the basis  of  the percentage of the value of the work as specified herein.

Delay of 1st 20 days ....... 0.1% per day

Delay of next 20 days ...... 0.15% per day

subject  to a maximum of 5% of the value of the  work.  The Owner/Engineer has the discretion to reduce or waive the Liquidated Damages.

16. Our Company comes under the statue of Factories Act, Rules, byelaws and  orders  made thereudner. Hence the Contractors must abide by the same.

17. The Contractor shall be responsible for all the safety measures as per the rules in the interest of safety of all the labourers working under him. Necessary safety appliances shall be provided to all the labourers at Contractor's cost.

Wherever it is observed that the contractor has not provided safety appliances to the workers engaged by him, the Manage­ment reserves the right to issue the necessary safety appliances to his workers on cost recoverable basis.

18. INDEMNIFICATION :

The Agency shall indemnify and keep indemnified the Company from and against all actions, claims, demands and/or liabilities whatsoever arising out of this agreement or consequent upon breach of any of provisions of this agreement and/or against any claim, action or demand by any of the Agency's Employees, person(s), firms, institutions under any law, rule or regulation having the force of law, including but not limited to, claims against the Company under Workmen's Compensation Act, 1923. The Employees State Insurance Act, the Employees Provident Fund Act, 1952, The Contract Labour (Abolition & Regulation) Act, 1970 and the Minimum Wages Act, 1948 and any amendments thereto.

PREAMBLE AND SPECIAL CONDITIONS

A. Introduction :

Kudremukh Iron Ore Company Ltd.(KIOCL), Mangalore unit comprises of:

1) Filtration unit and port facilities: Iron ore slurry received from Kudremukh is dewatered by vacuum disc filters (18 in nos.) and filtered dry ore concentrate is stored in two covered stockpiles having a total capacity of 4,00,000 tones. Iron ore concentrate is reclaimed, from stockpile, with the help of reclaimers and is supplied to pellet plant or loaded into ship through ship loader of 6000 tones per hour capacity .

2) Pellet Plant : A 3.5 million tone per year pellet plant, on Lurgi Straight Grate Process, to produce High-grade DR and BF grade iron oxide pellets. The process of pelletisation involves mixing of iron ore concentrate with Lime, Coke and Bentonit powder as additives. The mixed material is then fed to palletizing discs for production of green pellets. The green pellets, after removing unsized material, are fed to indurating machine where green pellets are dried, pre-heated, fired at high temperature and cooled. The fired pellets, after removing undersize material, are conveyed to pellet stockpile .

3) Screening and grinding facilities : Owing to strategic reasons and to continue pellet production, K.I.O.C.L has decided to buy hematite Iron ore fines from alternative sources. The needed infrastructure for receiving, screening and grinding hematite iron ore fines from alternative sources is under execution and trial run is expected to commence shortly.

4) Captive Power Plant : To meet the power demand at Mangalore unit, K.I.O.C.L has installed a captive power plant consisting of three diesel generating sets of 9.36 MW capacity each, based on using furnace oil fuel and employing the latest automated control system.

5) Kudremukh Iron and Steel Company Ltd. (KISCO) : KISCO is situated just opposite to KIOCL's pelletisation plant. KISCO has a blast furnace of 300-meter cube capacity to produce 2,30,000 tones of high-grade pig iron per annum. It is in a position to meet internally its power requirement through a 2 x 3.5 MW captive power plant using surplus blast furnace gas as the energy input.

Due to strategic reasons, KIOCL is looking for alternative sources of water to meet its water requirement at existing port facilities, pellet plant, captive power plant, proposed receiving, screening and grinding facilities and at Kisco. Before identifying any such source KIOCL wants to know its water requirement at various units by conducting a detailed water audit.

A typical water balance sheet is enclosed for reference only.

B. The Scope of Work : -

  The scope of work includes:

· Detailed study, including water analysis, of all available water sources at site.

· Identifying all water consuming equipments, process and utilities (general & mucilaginous).

· Determining water quality needs for each equipments/process.

· Quantifying water flow rates for each equipments, process, & utilities.

· Identifying all water losses and water incorporated in product.

· Identifying excessive water pressure areas and leaks.

· Detailed analysis of all possible areas of water conservation, recycling and harvesting.

· Judging current water use efficiency and finding out scope for improvement for each operation.

· Detailed analysis of present in-house maintenance.

· Analysing the possibilities of cost reduction through improving chemical treatments, electrical pumping and on site pre-treatment and related operating cost.

· Detailed water balance for each processes and utilities indicating various losses and make up required.

· Water required per day & per month by KIOCL and KISCO individually.

· Long term water management planning.

C. NOTE : -

· The agency has to bring his own instruments.

· Online meters are not available for measurement of flow

D. Completion time : -

  Conducting measurement studies and submission of draft report for KIOCL comments shall be completed within FIFTEEN DAYS from the date of issue of work order.

Final report incorporating KIOCL comments, if any, shall be completed within a week from the date of receipt of KIOCL's comments.

E. The final water audit report is to be submitted in six hard copies & one CD-Rom. Draft audit report to be submitted in two hard copies and one CD-Rom.

F. The agency has to make their own arrangements for stay and transport.

G. PAYMENT TERMS :

50% payment less statutory deductions will be made after completion of conducting measurement studies and submission of draft report for KIOCL comments.

Balance payment shall be released after submission of final report incorporating KIOCL comments.
